Continuous Woodland Creation Subscription Terms and Conditions

1. Subscription Overview: This document outlines the terms and conditions governing your continuous monthly subscription (“Subscription”) with “Beds4Nature” by ACT Studios Limited. By subscribing to our services, you agree to be bound by these terms and conditions.
2. Subscription Period and Tree Planting Ownership: a. Your Subscription is continuous and ongoing, and you may terminate it at any time with one month’s notice. b. Tree planting ownership funded through your Subscription remains with ACT Studios Limited until the trees are fully paid for, typically after one year of continuous Subscription payments. c. If you cancel your Subscription before any of the trees are fully paid for, ACT Studios Limited will retain tree planting ownership of the unpaid trees and may choose to resell them. No refund or compensation will be provided for the payments made up to that point.
3. Payment: a. You agree to pay the subscription fee (“Subscription Fee”) on a monthly basis for as long as your Subscription remains active. b. The Subscription Fee covers the cost of trees, planting, maintenance, and associated project expenses.
4. Cancellation: a. You can cancel your Subscription at any time by providing written notice to ACT Studios Limited with one month’s notice. b. If you have paid for the full cost of a tree and then cancel, the tree planting ownership will remain with you.
5. Intellectual Property and Copyright: a. All materials, including text, images, logos, designs, and content provided by ACT Studios Limited and displayed on our website and marketing materials are protected by copyright and other intellectual property laws. b. You agree not to reproduce, distribute, modify, or use any of ACT Studios Limited’s copyrighted materials without explicit written permission from ACT Studios Limited. c. Any materials, content, or contributions provided by you to ACT Studios Limited for use on our website or in marketing materials may be subject to review, modification, and potential rejection at ACT Studios Limited’s discretion.
6. Limitation of Liability: a. ACT Studios Limited shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our materials, services, or website. b. You agree to use our materials, services, and website at your own risk, and ACT Studios Limited disclaims any and all warranties, whether express or implied.

10. Developer Terms and Conditions: a. The trees planted as part of this Subscription are commissioned from developers who may have their own terms and conditions. By subscribing to our service, you acknowledge and agree that you are also bound by the terms and conditions of the developers involved in the tree planting process. b. Please refer to the developers’ terms and conditions for more information about their policies and requirements, which may apply to your Subscription.
11. Environmental Considerations: You acknowledge that tree growth rates, survival rates, and project outcomes can vary based on environmental factors beyond the control of ACT Studios Limited. ACT Studios Limited will make reasonable efforts to ensure the success of the projects.
12. Risk and Liability: Investing in woodland projects involves inherent risks. ACT Studios Limited shall not be liable for any losses, damages, or outcomes related to factors beyond its control, including but not limited to natural disasters, disease outbreaks, or regulatory changes.
13. Governing Law and Dispute Resolution: a. These terms are governed by the laws of England and Wales. b. Any disputes arising from or related to these terms shall be resolved through arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). Each party shall bear its own costs associated with arbitration.

Client’s Ownership Clarification: a. The Client acknowledges and agrees that their participation in this Subscription does not confer ownership of the trees or the land on which the trees are planted. b. The Client’s ownership, as facilitated through this Subscription, pertains to the fact that they have made the tree planting of specific trees possible by providing funding and support. c. The Client’s participation and support contribute to the environmental initiatives and tree planting projects of ACT Studios Limited, and they may receive updates on the progress and success of these projects as part of their Subscription.

By subscribing to our continuous woodland creation projects within the Beds4Nature scheme, you acknowledge that you have read, understood, and agree to these terms and conditions.
